Dr Mutiso murder: Lawyer Angela Mulwa released on bond
This story has significance for readers across Kenya and beyond.
A lawyer arrested and detained over the alleged theft of high-end motor vehicles from the Mlolongo home of slain top psychiatrist Dr Victoria Mutiso has been released on a Sh1 million bond with one surety of a similar amount.
Ms Angela Mulwa was released by Magistrate Lilian Kwamboka after she rejected an application by the Director of Public Prosecutions (DPP) to have her detained for a further seven days.
Ms Kwamboka dismissed the application, saying no compelling reasons had been advanced to warrant the suspect’s further detention.
The magistrate upheld objections by Ms Mulwa’s lawyers: Danstan Omari, Martina Swiga, Cliff Ombeta and Shadrack Wambui, who argued that police should not be allowed to detain the advocate any longer.
“I urge this court to decline the plea to keep Angella for another minute in detention. She has been in custody for 14 days and serious crimes detectives should have completed their probe into the theft of the top-of-the-range vehicles from the Mlolongo residence of the deceased,” Mr Omari submitted.
Ms Swiga said Ms Mulwa, an officer of the court, would cooperate with investigators to facilitate the completion of the probe.
She said the lawyer was willing to report to the investigating officer whenever required.
“The suspect is an advocate and not a flight risk. She will abide by the bond terms which will be imposed,” Ms Swiga told the court.
She urged the court to release Ms Mulwa on bond, arguing that it was her constitutional right under Article 49(1)(h).
Mr Omari undertook to avail Ms Mulwa to investigators whenever she was required for questioning.
Mr Wambui said Ms Mulwa was one of the lawyers representing her mother, Ms Rose Mbithe Mulwa, and brother, Chris Mulwa, who remain in custody over the killing of Dr Mutiso on July 29, 2026.
Police had sought seven more days to complete their investigations.
Detectives are investigating whether Ms Mulwa and another suspect, Nelson, allegedly forged eviction orders relating to the Mlolongo property.
In her ruling, Ms Kwamboka declined the DPP’s request to detain Ms Mulwa for a further seven days.
“The application to detain the suspects for a further seven days is hereby rejected as no compelling reasons were adduced for extended detention,” the magistrate ruled.
The court granted Ms Mulwa a Sh1 million bond with one surety of a similar amount.
She was ordered not to leave the court’s jurisdiction and not to interfere with the investigations. The magistrate also directed her to report to the investigating officer once a week until further orders of the court.
The matter will be mentioned on August 26, 2026, when police are expected to update the court on the progress of their investigations.
The 14-day detention order granted to police lapsed on August 19, 2026.
Police are holding five suspects in connection with the killing of Dr Mutiso, who was the former co-wife of Ms Rose Mbithe Mulwa.
Ms Mbithe divorced Prof David Musyimi Ndetei in 2001 and the two had been separated for 25 years.
Besides Ms Mbithe and her son, Chris, DCI officers arrested Police Constable Elijah Kibellion Kimoi of Karinde Police Post, whom detectives allege shot Dr Victoria Nthunya Mutiso.
PC Kimoi was arraigned alongside Daniel Mwangi Njoroge and Kevin Ngugi Kinuthia.
The three were detained for 30 days to allow police to investigate the circumstances and motive behind the killing of the prominent neuroscientist on July 29, 2026.
Ms Mbithe, 75, and her son Chris will appear in court on August 25, 2026, when police are expected to inform the court whether they have completed their investigations and whether the two will face murder charges.
