16-year-old girl testifies in defilement case against her father

The girl, identified in court, was testifying in a case where her father, Alex Wafula, is charged with incest contrary to Section 20 (1) of the Sexual Offences Act No. 3 of 2006.
While giving evidence-in-chief before Presiding Magistrate Keyne Gweno, A.W told the court that after their mother’s death, she and her three sisters were left under their father’s care.
The court heard that due to threats, the girl confided in one of her teachers about the alleged abuse. The suspect was later arrested and detained at Langas police station.
The charge sheet states that on diverse dates between January 16, 2026 and February 6, 2026 at Lemook Estate, Kapseret sub-county, Uasin Gishu county, the accused intentionally and unlawfully defiled his daughter.
Wafula denied the charge during plea-taking and was granted a bond of Ksh. 300,000 or a cash bail of Ksh. 100,000.
He was unable to raise either, and the court ordered that he be remanded at Eldoret GK Remand Prison pending hearing. The magistrate declined his request to have the cash bail reduced to Ksh. 50,000.
Dr. Irene Simiyu of Moi Teaching and Referral Hospital (MTRH) also testified and confirmed that the girl had been defiled.
The prosecution has lined up five witnesses, including the investigating officer.
The case will be mentioned on September 8, 2026 for further hearing.
